Bitten by a Dog in Ogden? Moxie Law Group Can Help
Reviewed by Kara H. North, Managing Attorney at Moxie Law Group. Reviewed September 2026.
Ogden is a dog town. The Ogden River Parkway, the Bonneville Shoreline Trail above the East Bench, and the neighborhoods around 25th Street are full of dogs, and most of them are fine. When one is not, Utah law is on your side: under Utah Code 18-1-1 the owner is liable for the injury whether or not the dog had ever bitten anyone before. Moxie Law Group represents dog bite victims across Weber County and handles the owner’s insurance company so you can focus on healing. We work on contingency, so you pay nothing unless we win.
How Utah Dog Bite Law Works in Ogden
Dog bite claims turn on a few rules that most people have never heard of.
- Utah is a strict liability state. You do not have to prove the owner was careless or knew the dog was dangerous. If the dog bit or injured you, the owner (or whoever was keeping the dog) is responsible.
- The defenses are narrow. An owner can push back if you were trespassing, provoking the dog, or handling it as a veterinarian or groomer who accepted the risk. Police dogs acting under command are exempt. Beyond that, expect the insurer to argue comparative fault; you can still recover as long as you were less than 50 percent responsible.
- Ogden’s leash law is evidence. Ogden and Weber County require dogs to be leashed or confined off the owner’s property. A dog running loose on the Parkway or in a Harrisville cul-de-sac is a violation, and Weber County Animal Services keeps the bite reports and any prior dangerous-dog designation.
- Homeowners or renters insurance usually pays. Most claims are paid by the owner’s policy, not the owner. Nationally, insurers paid $1.57 billion on dog-related injury claims in 2024, an average of $69,272 per claim, according to the Insurance Information Institute.
- You have four years. Utah Code 78B-2-307 gives you four years from the bite to file a lawsuit. If the dog belonged to a government agency, a notice of claim is due within one year.
What to Do After a Dog Bite in Ogden
Get the wound treated the same day at McKay-Dee Hospital, Ogden Regional Medical Center, or an urgent care; dog bites infect easily and the medical record starts your claim. Get the owner’s name, address, and proof of the dog’s rabies vaccination. Photograph the injury, the location, and the dog if you safely can, and get contact information from any witnesses. Report the bite to Weber County Animal Services so there is an official record. Then call a lawyer before the owner’s insurer calls you; a recorded statement given early is the most common way a strong dog bite claim gets weakened. Because Ogden is in Weber County, a lawsuit is filed in the Second Judicial District Court in Ogden.
Common Questions From Ogden Dog Bite Victims
The dog had never bitten anyone before. Does that matter?
No. Utah does not have a “one free bite” rule. The owner is liable for the first bite.
The owner is my neighbor. Do I have to sue them?
Usually not. The claim is made against their homeowners or renters insurance, and most cases settle without a lawsuit.
Will the dog be put down if I report the bite?
Rarely. Weber County Animal Services investigates and may quarantine the dog or designate it dangerous; euthanasia is reserved for serious or repeat attacks.
What can I recover?
Medical bills, including future scar revision or reconstructive surgery, lost wages, and compensation for pain, scarring, and the fear that often follows an attack, especially for children.
What will a lawyer cost me?
Nothing up front. We work on contingency.
How Moxie Law Group Helps Ogden Dog Bite Victims
We pull the animal control report and any prior complaints about the dog, document the injury and its long-term effect, identify every policy that may apply, and deal with the adjuster so you never have to. Children’s cases get special care, since scarring and trauma can carry into adulthood and settlements for minors require court approval in Utah.
