Insurance Denied My Claim What Do I Do Now?

It Depends; Why Was Your Claim Denied?

If your claim has been denied, the insurance company is required to tell you why they’ve denied your claim. They cannot deny your claim for no reason at all, nor can they decline to give you a reason for denying your claim. This obligation to inform you about their decision is known as “good faith and fair dealing” and is required of all insurance companies. However, your next steps will depend on why your claim was denied. For example, if your claim was denied because your insurance was lapsed at the time of the crash, a personal injury attorney is not likely going to be able to help you get compensation from your own insurance company. But, if the insurance company denied your claim for another reason—such as they’re claiming you were at fault for an accident, a personal injury attorney may be able to help.

You’re the At-Fault Party

You can’t file a claim for bodily injury with an insurance company if you were the at-fault party in a car crash. Insurance companies are supposed to investigate and determine, based on their investigation, which party caused the car crash. Just because the insurance company has decided that you caused the accident doesn’t mean that you actually did. If your claim is being denied because you’re considered to be the at-fault party, a personal injury attorney may be able to help you by gathering evidence to prove that you were not at fault for the car crash. Personal injury attorneys give their potential clients free consultations to help them determine whether or not they have a claim. If the insurance company is claiming that you are at fault for the car accident, but you don’t think that you are, it may be a good idea to have a personal injury attorney weigh in.

You Didn’t Get Treatment

If you are injured, you need to get medical attention as soon as the injury becomes apparent. When a medical professional prescribes a treatment for you, and you ignore their advice, refuse to follow their treatment plan, or otherwise put off getting treatment, the insurance companies may try to argue that you either aren’t injured, or were injured due to some other cause, not the crash. In this case, a personal injury attorney may be able to help prove that you were indeed injured by the other party’s negligence. If you are in this situation, it may be a good idea to speak to a personal injury attorney who can help walk you through your options. As previously mentioned, attending a free consultation may be a good starting point.

You’ve Already Settled

Those who have sustained injury in a car crash need to be exceedingly careful when reading through the terms of their settlement. If you are injured, and you receive a settlement, there’s likely language within that settlement release agreement that prevents you from making additional claims relating to the incident. So, if you break your leg in a car crash, and you’re compensated for your injury related expenses—but you forgot to get compensation for lost wages for the time you stayed home from work due to your injuries, you won’t be unable to file another claim for compensation. If you have already settled your claim, hiring a personal injury attorney will not help you get additional compensation. This is why it’s important to talk to an attorney prior to signing anything with the insurance companies.
