Okay, so you’re driving down the street and you’re sitting at a stop light when a distracted driver rear-ends you. And, this isn’t just a typical rear-end collision; you’re badly injured. We’ve got a checklist for what you should do immediately after the accident. This blog is more about what you can do in the days after the accident. Obviously, you’ll want to call your insurance company and tell them what happened. Your insurance company will talk to the other party’s insurance company and work together to determine who’s at fault for the accident. Assuming you didn’t cause the crash, the insurance company of the person who hit you will write you a check to pay for your medical bills and property damages. If you caused the crash, then your insurance company will pay.

HOW MUCH WILL INSURANCE PAY?

You pay an insurance company an amount of money each year. In exchange, they’re willing to pay for the car repairs and medical expenses when you cause a car accident. Insurance companies only pay up to a certain amount, known as the policy limit. If you have a $50,000 policy, but you cause $100,000 worth of damage, the insurance company will only pay $50,000. However, insurance companies are looking out for their bottom line. A lot of insurance companies will look for any reason to pay the injured party less money. When an insurance company offers the injured party a check, or a settlement, the injured party can either accept the check, or reject it. Accepting the check may not be a bad idea if you know that it will cover all your expenses. But what happens if the settlement check doesn’t cover all your expenses?

WHAT IF THEY DON’T PAY ENOUGH? – WHAT DO I DO AFTER A CAR CRASH

When the check the insurance company offers isn’t enough, a personal injury attorney will gather evidence and present it to the insurance company. A personal injury attorney’s job is to prove to the insurance company that they didn’t offer you enough money to pay your medical bills. Then, personal injury attorneys and insurance companies work together to agree on a sum that’s fair for the injured person. However, the attorneys and insurance companies don’t always agree. When they absolutely cannot agree, they go to trial. After a trial, the jury will decide how much, if any, the insurance company will have to pay the injured party.

WHAT IF INSURANCE WON’T PAY?

If the insurance company has denied your claim in bad faith, or has offered you a sum that’s far below what you need to pay your bills, you may need to speak with a personal injury attorney. Sometimes, when an injury is severe, you aren’t able to go to work and earn a paycheck. When this happens, lawyers refer to it as loss of income. For particularly severe injuries, you may not be able to work the same job you were working before the injury happened. In this case, attorneys refer to it as loss of earning potential.
