4 Red Flags to Look for in a Personal Injury Attorney

ELI5: Negligence

Attorneys have a bad reputation. Though not every attorney deserves a bad reputation—in fact, most don’t—there will always be a few bad attorneys who are willing to ruin the profession for the rest of us. If you’re looking for a personal injury attorney, it’s imperative that the attorney you choose is interested in representing you and your best interests. Personal injury attorneys are supposed to be helping you get the compensation you need in order to get back on your feet after a tragedy. Therefore, a good personal injury attorney will be looking for ways to help you instead of looking for ways to line their pockets. If you’re thinking of filing a personal injury claim, make sure you avoid these red flags when choosing an attorney.

THEY DON’T RESPOND TO YOU

You can’t expect your attorney, or their legal team, to reply to all of your communications instantaneously. However, you should reasonably be able to expect a response within the next business day or two. Even if your attorney is on trial at the time you sent your email, someone from their office should respond promptly, notifying you that the attorney, or their legal team, will return your communications at a later date. If you are constantly being given the run-around, or unable to get past the receptionist, you may want to consider finding a different attorney. Though your attorney may not be able to respond to you outside of business hours, or on weekends, their office should be returning all of your messages and calls within a timely manner.

THEY DON’T UPDATE YOU

Your attorney’s office should also be reaching out to you periodically to discuss the status of your case. It isn’t uncommon for cases to go months without much news, but an attorney’s office should reach out to you once a month or so in order to let you know they’re still working and to tell you what’s going on with your case. If the firm you’re working with is intentionally vague, refuses to answer your requests for status updates, or does not update you, that could be a red flag. A good personal injury attorney is acutely aware of just how much these cases mean to their clients. Oftentimes, clients are filing a personal injury claim because they cannot pay the medical bills for the injuries the defendant has caused them. They’ve experienced pain, discomfort, inconvenience, and missed time from work. If your attorney isn’t sensitive to this, you may decide to find an attorney who can appreciate just how important your case is to your well-being.

THEY PROMISE YOU MILLIONS OF DOLLARS

A good personal injury attorney would be uncomfortable with putting a dollar value on your case, especially during an initial consultation. Promising millions of dollars and a speedy resolution may be a red flag. No two personal injury cases are alike. Even though two incidents may be similar, defendants may have different insurance coverage and the judgments or settlements can be wildly different. There are so many factors that go into determining what a case is worth, it’s actually irresponsible to promise a potential client a set amount of money from a settlement or judgment.

THEY DEMAND PAYMENT UPFRONT

Finally, a personal injury attorney should never demand payment upfront. The vast majority of personal injury attorneys work on contingency. This means, personal injury attorneys do not get paid unless the attorney settles the case or wins the case in trial, and the attorney gets paid with a percentage of the settlement or judgment. Furthermore, most personal injury attorneys offer clients a free case evaluation or free consultation. Personal injury attorneys do this because they want to make their services widely available to anyone who may need it. A lot of people would not be willing or able to risk hundreds of dollars just trying to find out whether or not they have a case. Therefore, a good personal injury attorney makes sure that their potential clients don’t have to put themselves in financial jeopardy in order to get the compensation needed to pay their medical bills.
